Booking and Stay Terms and Conditions

1. Scope

These terms govern direct bookings and stays at the properties managed by Orion Stays and published on this site. By booking, the guest confirms having read and accepted them. Each property's Italian registration code (CIN, or CIR where still in use) is published on that property's own page, at the end of the "House rules" section, together with the check-in and check-out times, the minimum stay and the tourist tax rate.

2. Booking and conclusion of the contract

Select property, dates and guests and pay the 35% deposit online (the percentage applied is always shown in the summary before payment). The contract is concluded upon successful payment of the deposit, confirmed by email with a booking code, which is the confirmation on a durable medium required by Art. 51(2) of the Italian Consumer Code. The payment session stays valid for 30 minutes: if payment is not completed within that time the request lapses automatically and the dates become available again.

3. Prices and payments

  • Prices are in Euro, inclusive of VAT where due.
  • The total stay price is made up of the price of the selected nights (which can vary by season, day of the week and period), the final cleaning, any supplement for guests above the threshold shown on the property page, and any discount applied with a valid promotional code. We charge no booking fees and no service fees: the amount shown as "Total stay" in the summary before payment is the amount due.
  • The deposit (35%) is paid online on Stripe's secure payment page, to which you are redirected: Orion Stays never receives or stores card details. The balance (65%) is paid at the property on arrival, as arranged with the operator.
  • The municipal tourist tax is NOT included in the total and is paid separately at the property, at the rates shown on each property page (with children's exemptions where they apply). The amount shown in the summary is an estimate based on the number of guests and nights.

4. Cancellations, changes, no-show

  • Free cancellation up to 7 days before check-in, with full refund of the deposit to the original payment method (bank times: typically 5-10 business days).
  • After that, requests are assessed case by case; unless otherwise agreed the deposit is non-refundable.
  • In case of no-show the deposit is retained and the booking is deemed cancelled from 2:00 AM after the planned arrival day, unless otherwise notified.
  • Date changes are subject to availability and possible price adjustment.

5. Right of withdrawal

Under Art. 59(n) of the Italian Consumer Code (implementing Directive 2011/83/EU), the 14-day withdrawal right does not apply to accommodation contracts with a specific date or period. The cancellation terms in section 4 apply.

6. Check-in, check-out and legal obligations

  • Self check-in during the hours published on each property page: normally from 3:00 PM to 2:00 AM, with check-out by 10:00 AM, unless otherwise agreed.
  • On arrival every guest must provide a valid identity document, required for mandatory reporting to the Italian police (Art. 109 T.U.L.P.S.). Without it, the stay cannot be allowed and no refund is due.

7. Guest obligations and house rules

Guests must comply with the house rules on each property page (maximum occupancy, no parties or events, no smoking indoors, quiet hours), take care of the property and promptly report any damage. Damage caused is charged to the guest. Serious breaches (undeclared occupants, parties, unlawful activities) entitle the operator to terminate the stay without refund.

8. Liability and force majeure

The operator is not liable for issues caused by force majeure or third parties (utility outages, natural events, authority measures). If the property becomes unavailable for reasons not attributable to the guest, the operator will offer an equivalent alternative or a full refund of the amounts paid, excluding further compensation except as mandated by law.

9. Complaints, dispute resolution, governing law and jurisdiction

For complaints write to info.orionxgroup@gmail.com or the WhatsApp number on this site: we undertake to reply promptly and to look first for an amicable solution.

  • Alternative dispute resolution (ADR): if our reply is not satisfactory, a consumer guest may turn to an alternative dispute resolution body entered in the lists kept by the competent authorities under Articles 141 et seq. of the Italian Consumer Code (Legislative Decree 206/2005) — for example the conciliation bodies of the Italian Chambers of Commerce. Using ADR is optional, free or low-cost depending on the rules of the body chosen, and does not affect the right to go to court.
  • Governing law: these terms are governed by Italian law; the more favourable mandatory provisions of the law of the consumer guest's country of habitual residence continue to apply.
  • Consumer's court: in disputes with a consumer, jurisdiction lies exclusively with the court of the consumer's place of residence or domicile, where located in Italy (Art. 66-bis of the Italian Consumer Code).

10. Pre-contractual information (Art. 49 Italian Consumer Code)

Before the booking is completed, the site makes available to the consumer guest, in a clear and comprehensible way, the information required by Art. 49 of the Italian Consumer Code:

  • identity and contact details of the trader: company details, registered office, VAT number, email address and WhatsApp number are shown at the top of this page and in the site footer; support answers at the same contacts;
  • characteristics of the service: description, photographs, amenities, maximum occupancy, minimum stay, check-in and check-out times, house rules and registration code (CIN/CIR) are published on each property page;
  • total price and how it is made up: the summary shown before payment sets out the total stay price (nights, final cleaning and any supplements or discounts), the deposit due now, the balance due at the property and, as a separate line excluded from the total, the estimated tourist tax (section 3);
  • payment and performance arrangements: the deposit is paid electronically on Stripe's secure page, the balance and the tourist tax at the property; the service is performed on the stay dates selected by the guest;
  • cancellation and withdrawal: the conditions are set out in sections 4 and 5 and summarised on the "Booking policy" page;
  • personal data: the site's Privacy Policy and Cookie Policy.

Before proceeding to payment the guest must expressly accept, through separate tick boxes, these terms and the privacy policy, the house rules, and the deposit/balance policy. The contract is concluded in Italian or English, depending on the language in which the guest uses the site; the two versions of these terms have the same content.
